WeSurph Terms of Service and Provider Terms

By using WeSurph, you agree to these Terms and to the policies presented for a specific booking, rental, payment, or feature. These Terms govern use of the WeSurph app, website, provider portal, marketplace, and related services.

1. The marketplace

WeSurph helps learners find instructors, renters find boards, and approved providers offer lessons or equipment. Unless expressly stated otherwise, providers are independent users and are not WeSurph employees, agents, or partners. WeSurph does not control the ocean, weather, individual conduct, or the condition of every third-party item.

2. Accounts and eligibility

Keep your account accurate and secure, use only your own Sign in with Apple credential, and notify us of unauthorized access. You may not impersonate another person, evade a suspension, scrape the service, interfere with security, or use WeSurph unlawfully. The initial service is limited to adults age 18 or older in supported United States locations. Providers must also be approved before provider tools unlock.

3. Bookings, rentals, prices, and fees

Your booking details show the provider, service or board, scheduled time, booking price, and total charge before payment. Any applicable tax or other charge must be included in the disclosed total before you authorize payment. Apple Pay may be used as the wallet interface, while Stripe processes marketplace payments and provider payouts. WeSurph deducts a platform fee of 12% of the booking amount processed through WeSurph from the provider's proceeds, together with any separately disclosed, permitted adjustments. These launch terms do not collect a security deposit or authorize an automatic damage or late-return charge.

The Cancellation and Refund Policy presented at checkout governs cancellations and refunds. A request received at least 24 hours before the scheduled start qualifies for a full refund of a cancellable paid booking; later requests receive individual support review. A provider or safety cancellation receives a full refund of a paid booking. Postponement cancels and refunds the original paid booking and requires a separate new booking. A collected board must follow the return and evidence process before support reviews a refund. The policy does not impose an automatic late-cancellation fee or automatic refund denial. 4. Safety and assumption of risk

Surfing, water activities, instruction, transportation, and equipment rental involve inherent risks, including changing conditions, currents, collisions, injury, illness, property damage, and death. Evaluate conditions and your abilities, obey lifeguards and local rules, use suitable safety equipment, and stop when conditions are unsafe. WeSurph is not an emergency service and does not replace professional medical, rescue, weather, or ocean-safety advice.

5. Lessons and instructor responsibilities

Learners must disclose relevant experience and follow reasonable safety directions. Instructors must accurately describe qualifications, prices, availability, class size, and services; make a documented readiness decision; operate within their competence; and maintain any licenses, certifications, permits, or coverage required for their activities. The Lesson Participation and Safety Terms presented at checkout describe the activity risks, readiness process, and participant responsibilities. These Terms do not promise insurance coverage or require a release of liability. Stop and seek appropriate assistance when an activity is unsafe.

6. Board rentals

Owners must accurately describe the board, condition, price, availability, and material limitations. Renters must inspect the board, use it lawfully and appropriately, follow handoff and return instructions, and report damage or safety concerns promptly. Condition photos and verification PINs form part of the transaction record. The Board Rental Agreement presented at checkout describes inspection, actual handoff, return evidence, and support review. A pickup code or condition report does not authorize an additional charge or decide a disputed damage claim.

7. Provider Terms

Provider access is conditional on application review and may be restricted, suspended, or removed for inaccurate information, expired credentials or coverage, safety concerns, fraud, unlawful conduct, excessive disputes, or policy violations. Providers set their offered prices subject to platform minimums or limits shown in the product and authorize WeSurph and its payment processor to collect charges, deduct the disclosed 12% platform fee, handle refunds under the Cancellation and Refund Policy and other separately disclosed permitted adjustments, and pay the remaining balance to the connected payout account. Approval is not an endorsement or guarantee of bookings.

8. Content, media, badges, and reviews

You retain ownership of content you create. You grant WeSurph a worldwide, nonexclusive, royalty-free license to host, process, display, resize, and share that content only as needed to operate features you choose. Do not upload content you lack rights or permission to use. Badges and reviews reflect platform activity and are not professional licenses, safety guarantees, or endorsements.

9. Moderation and account action

We may investigate reports, preserve relevant records, limit content or features, pause payments, or suspend accounts to protect users, comply with law, or enforce these Terms. We may use automated systems to organize signals, but consequential safety, credential, suspension, and liability decisions are subject to human review.

10. Disclaimers and limits

To the extent permitted by law, WeSurph is provided “as is” and “as available.” We do not guarantee provider availability, specific results, uninterrupted service, user conduct, conditions, or equipment quality. Nothing in these Terms excludes rights or liability that cannot lawfully be excluded. These Terms do not add an agreement to arbitrate, a class-action waiver, an indemnity, or a contractual liability cap.

11. Changes and contact
