Public business/support address: 6826 Via Verano, Carlsbad, California 92009, United States. 1. Your lesson These terms apply to the surf lesson identified in your WeSurph booking. Read them with the Terms of Service, Privacy Notice, and Cancellation and Refund Policy presented at checkout. Your booking identifies the instructor, meeting details, scheduled time, service, and total charge. The initial service is for adults age 18 or older. The instructor provides the lesson; WeSurph provides marketplace and transaction services as described in its Terms of Service. 2. Understanding the activity Surfing and ocean instruction involve changing waves, currents, tides, weather, visibility, other water users, equipment, and surfaces. Falls, collisions, exhaustion, loss of equipment, injury, illness, drowning, and death can occur. Conditions may change during a lesson, and an app forecast, profile, credential, rating, or badge cannot establish that a particular activity is safe for you. Choose a lesson suited to your experience and comfort in the water. Tell the instructor about your relevant experience and any practical limitation that affects your ability to follow the proposed activity safely. Ask questions before starting and whenever instructions or conditions are unclear. Participate only while you are willing and able to do so safely. 3. Preparing and responding to conditions Before entering the water, confirm the meeting location and lesson plan with the instructor. Inspect the equipment you will use and raise concerns about fit, condition, or suitability. Follow lifeguard directions, closures, local rules, and the instructor's reasonable safety directions. Do not use a phone or camera in a way that distracts from safety in or near the water. The instructor must consider observed conditions, learner readiness, and hazards, and record a decision to proceed, modify, postpone, or cancel. That assessment supports the instructor's responsibilities; it does not guarantee safety or replace changing on-site information. A modification must be explained to the learner. If it requires a different date or time, handle it as a postponement and a separate booking. Stop and tell the instructor if you feel unsafe, cannot follow the activity, or notice a hazard. The instructor must stop or change an unsafe activity. A booking or payment does not require you to enter the water or continue when conditions or your readiness are unsuitable. 4. Provider qualifications and coverage Instructors must describe their qualifications and services accurately, work within their competence, and maintain the licenses, certifications, permits, and coverage required for their activities. Provider approval and badges do not promise that every provider has the same credentials, that WeSurph supplies insurance, or that a lesson is free of risk. Ask about a qualification or coverage that matters to your decision before participating; report inaccurate claims to support. 5. Cancellation and completion The Cancellation and Refund Policy governs cancellation and refunds. Its ordinary customer full-refund window includes requests received at least 24 hours before start. Later requests receive support review. A provider or safety cancellation receives a full refund of a paid booking. Postponement cancels and refunds the original paid booking and requires a separate new booking; it does not transfer the original acceptance or payment automatically. The instructor records lesson completion after the scheduled lesson has ended. A completion record or an earned activity badge is not a certification of skill, fitness, rescue ability, or safety. Contact support if the recorded outcome is inaccurate or if the service was not delivered as booked. 6. Incidents and support For immediate danger, seek assistance from on-site lifeguards or local emergency services. WeSurph support is not an emergency dispatch or rescue service. When safe, report an incident or concern through WeSurph or support@wesurph.com with the booking reference and relevant facts. Share only information needed to address the concern. Privacy questions may be sent to privacy@wesurph.com. 7. Acceptance and your rights By selecting the acceptance control presented with these terms, you confirm that you have had an opportunity to read them, understand the activity risks described here, and agree to the participation and safety responsibilities above. You may decline and stop checkout before payment. This acknowledgment does not release WeSurph, the instructor, or another person from liability, waive a claim, impose arbitration, or limit a right that applicable law does not allow you to waive.
