Public business/support address: 6826 Via Verano, Carlsbad, California 92009, United States. 1. The rental These terms apply to the board and rental identified in your WeSurph booking. Read them with the Terms of Service, Privacy Notice, and Cancellation and Refund Policy presented at checkout. The booking identifies the owner, board, rental period, meeting details, price, and total charge. The initial service is for adults age 18 or older. The owner supplies the board; WeSurph provides marketplace and transaction services as described in its Terms of Service. Rent only equipment appropriate for your abilities and intended activity. A board rental does not itself include instruction, supervision, or rescue services. No insurance coverage is promised by this agreement. Listing descriptions, ratings, photos, and badges do not guarantee equipment condition or safe conditions at the place of use. 2. Inspection and pickup The owner must accurately describe the board and material limitations and provide the booked equipment in the stated condition. Before accepting it, inspect the board and included accessories with the owner. Check the visible deck, bottom, rails, nose, tail, fins, and any supplied leash or attachments. Discuss existing marks, damage, missing items, and anything that makes the equipment unsuitable. Record the condition evidence requested by the handoff flow and keep relevant evidence of a disagreement. Do not accept or use equipment that appears unsafe or materially different from the booking. Raise the issue with the owner and support so it can be reviewed. A pickup code is for the actual handoff: share it only with the booked owner when the correct board is present and you are ready to take possession. The owner verifies the code to record pickup. Do not send it to another person or confirm a handoff that has not happened. 3. Safe use and care Surfing and equipment use can involve strong currents, changing waves and weather, collisions, falls, equipment failure, injury, drowning, death, and property damage. Follow lifeguards, local rules and closures, and reasonable equipment-use instructions. Use the board within your ability and for the agreed activity. Do not lend or transfer the rental to another person without arranging it with the owner through the booking process. Care for the board and supplied accessories, keep them reasonably secure, and stop using them if they become unsafe. Report a loss, damage, equipment concern, or incident promptly to the owner and support. Prioritize your safety and contact local emergency services or lifeguards when immediate assistance is needed. WeSurph support is not an emergency service. 4. Return and condition record Return the board and included accessories at the time and place agreed in the booking. If the normal return is unsafe or impossible, contact the owner and support promptly to arrange a safe resolution. Do not treat an unanswered message as an approved extension or leave the board unattended without an agreed return arrangement. At return, inspect the equipment with the owner and record its condition accurately. The owner must record the return condition and the six requested evidence views—deck, bottom, left rail, right rail, nose, and tail—to complete the return in WeSurph. Identify any disagreement or new damage without changing or misrepresenting the evidence. Keep your own relevant evidence and contact support if the recorded return is inaccurate. A completion status is a transaction record; it does not by itself decide a disputed damage claim. 5. Cancellation, refunds, and a collected board The Cancellation and Refund Policy governs cancellation and refunds. Requests received at least 24 hours before start qualify for a full refund of a cancellable paid booking. Later requests receive support review. A provider or safety cancellation receives a full refund of a paid booking. A new date or rental period requires cancellation and a separate new booking rather than automatic reuse of the original payment. After pickup, return the board and complete the required condition process before support reviews a refund. If an incident prevents the normal process, contact support and provide the relevant facts when safe. Returning early does not create an automatic prorated-refund formula; support reviews the circumstances and any applicable rights. 6. Deposits, damage, and additional charges These launch terms do not collect a security deposit or authorize an automatic damage, replacement, or late-return charge. Reporting damage, recording condition, sharing a pickup code, or completing a return does not authorize another charge. Support will review a reported problem with the parties and the available evidence. You may dispute an allegation and provide your account of events. This agreement does not decide legal liability for loss or damage, promise compensation to the owner, or remove either party's rights under applicable law. 7. Evidence, acceptance, and contact Condition records support the rental, safety, refund, and dispute processes described in the Privacy Notice. Use evidence relevant to the equipment and incident; avoid unnecessary images of other people or unrelated personal information. No fixed automatic evidence-deletion period is promised by this agreement. Contact privacy@wesurph.com about access or deletion requests. By selecting the acceptance control presented with this agreement, you confirm that you have had an opportunity to read it and agree to these rental responsibilities. You may decline and stop checkout before payment. This agreement does not release any person from liability, impose arbitration, or limit rights that applicable law does not allow you to waive.
